This is what you should do if the airline has lost your luggage

Complete the Baggage Irregularity Report (BIR)

In the event of an incident, you should always go to the Information Point Counter located near the baggage carousels (usually identified as "BAGGAGE," "LOST & FOUND," etc.) to request the Baggage Irregularity Report (BIR). Each airline has its own BIR document, which documents the opening of an incident with the luggage and includes the client's flight data and a reference number, which you will use to search for your luggage, as well as the contact phone number where the client can request information about the luggage incident, whether it is delayed, lost, or damaged.

Claiming for luggage damage, delay, or loss

Usually, the airline will try not to compensate you for the damage caused. To file a claim for the inconveniences caused by delayed, lost, or damaged luggage, you must submit a claim to specialized lawyers along with your copy of the BIR, according to the following deadlines established in the Montreal Convention:

Baggage damage: you have 7 days from receiving the luggage.

Baggage delay: up to 21 days from the date you were supposed to receive the luggage.

  • Compensation could be up to €4,000.
  • Compensation for incurred expenses: In addition to the compensation per day of delayed luggage (approx. €70), expenses resulting from not having the luggage, such as the purchase of toiletries, clothing, etc., can be added. They must be proven with receipts and invoices.
  • Compensation for damages: Furthermore, damage and harm caused by the inconveniences can and should be justified: not having clothes for an important meeting, not having the luggage during holidays, loss of medication, etc.

Baggage loss: There is no established limit in the Convention, but it is recommended to file a claim as soon as possible, after the 21 days during which the luggage has been "delayed," or after the airline has confirmed that the luggage is lost.

The airport is responsible for locating the luggage within the first 5 days of the loss. After this period, if they have not yet been located, the Lost and Found Department of the airline will be responsible for conducting an investigation for the next 21 days.

Know the types of deadlines for luggage incidents

  • In less than 21 days, it will be considered delayed luggage. The general principle is to cover basic expenses generated as a result of the delay in luggage delivery. Some airlines pay an amount per day, up to a maximum, and others make payments once the receipts for the expenses incurred by the passenger have been verified.
  • After 21 days from the flight, it is considered total luggage loss. According to EU regulations, the airline must provide compensation of up to €4,000. To do this, it is necessary to submit all the documents of the incident with which you have traveled. In the case of delay, compensation varies depending on the delivery time.
  • If your luggage appears damaged: many airlines make a payment based on the value of the suitcase or the item inside that has been damaged.
