This is what you should do if the airline has lost your luggage
Complete the Baggage Irregularity Report (BIR)
In the event of an incident, you should always go to the Information Point Counter located near the baggage carousels (usually identified as "BAGGAGE," "LOST & FOUND," etc.) to request the Baggage Irregularity Report (BIR). Each airline has its own BIR document, which documents the opening of an incident with the luggage and includes the client's flight data and a reference number, which you will use to search for your luggage, as well as the contact phone number where the client can request information about the luggage incident, whether it is delayed, lost, or damaged.
Claiming for luggage damage, delay, or loss
Usually, the airline will try not to compensate you for the damage caused. To file a claim for the inconveniences caused by delayed, lost, or damaged luggage, you must submit a claim to specialized lawyers along with your copy of the BIR, according to the following deadlines established in the Montreal Convention:
Baggage damage: you have 7 days from receiving the luggage.
Baggage delay: up to 21 days from the date you were supposed to receive the luggage.
Baggage loss: There is no established limit in the Convention, but it is recommended to file a claim as soon as possible, after the 21 days during which the luggage has been "delayed," or after the airline has confirmed that the luggage is lost.
The airport is responsible for locating the luggage within the first 5 days of the loss. After this period, if they have not yet been located, the Lost and Found Department of the airline will be responsible for conducting an investigation for the next 21 days.
