How much and when can I claim?

In most cases, in the event of a flight cancellation, it is usually the airline's fault. In these cases, there are automatic compensations according to European Regulation No. 261/2004. In this regulation, it was finally established that flight cancellations constitute inconvenient situations for passengers and can cause them great inconvenience that needs to be compensated.

Who does the Regulation apply to?

  • To all airplane passengers with a confirmed reservation.
  • On flights departing from a European airport or landing at a European airport, provided that in the latter case the airline is based in the European Union.

In this sense, it is irrelevant if passengers:

  • Are on a package tour.
  • Travel with a low-cost carrier.
  • Travel for work.
  • Are children (with a paid ticket).
  • Fly with free or discounted tickets through a customer loyalty program or points.

The regulation does not apply to:

  • Passengers traveling with a free or reduced rate that is not available directly or indirectly to the general public.
  • Passengers who have not arrived at the check-in counter on time. Except in exceptional cases, passengers must present themselves at the check-in counter at least 45 minutes before the departure time (except in case of cancellation).

What are extraordinary circumstances?

European Regulation No. 261/2004 stipulates that if the airline is not responsible for the delay or cancellation of the flight, it is not obliged to compensate its passengers. "Extraordinary circumstances" thus exempt airlines from compensatory payments.

Here are some examples:

  • Restriction of airspace.
  • Airport closure.
  • Political instability.
  • Inevitable security risks.
  • Airport staff strikes.
  • Bird strike on the plane's engine.
  • Adverse weather conditions.

If you arrived at your final destination 3 or more than 3 hours late. The amount will range between €250 and €600, depending on the flight distance. Unless the airline can prove that the delay was due to extraordinary circumstances.

Furthermore, the airline must offer you the option to choose either a refund of the ticket cost or transportation to the final destination under comparable conditions. If the company does not offer you alternative transportation and you decide to travel on your own, you are entitled to be reimbursed for any expenses you incurred to reach your destination.
