How much and when can I claim?

In most cases, a flight cancellation is usually the airline's fault. In these cases, there are automatic compensations according to the European Regulation No. 261/2004. In this regulation, it was finally established that flight cancellations constitute inconvenient situations for passengers and can cause them significant inconvenience that needs to be compensated.

Who Does the Regulation Apply to?

  • To all airplane passengers with a confirmed reservation.
  • On flights departing from a European airport or landing at a European airport, provided that in the latter case, the airline is based in the European Union.

In this sense, it is irrelevant whether passengers:

  • Are on a package holiday.
  • Travel with a low-cost carrier.
  • Are traveling for work.
  • Are children (with a paid ticket).
  • Are flying with free or discounted tickets through a customer loyalty program or points.

The regulation does not apply to:

  • Passengers traveling with a free or reduced fare that is not available directly or indirectly to the general public.
  • Passengers who have not arrived at the check-in counter on time. Unless exceptions apply, passengers must present themselves at the check-in counter at least 45 minutes before the scheduled departure time (except in the case of cancellation).

* If the airline informed you of the cancellation at least 14 days before the flight, or if the airline can prove that the cancellation was caused by extraordinary circumstances, you are not entitled to compensation.

What Are Extraordinary Circumstances?

European Regulation No. 261/2004 stipulates that if the airline is not responsible for the delay or cancellation of the flight, it is not obliged to compensate its passengers. "Extraordinary circumstances" thus exempt companies from compensatory payments.

Here are some examples:

  • Airspace restrictions.
  • Airport closure.
  • Political instability.
  • Unavoidable security risks.
  • Airport staff strikes.
  • Bird strike with the airplane engine.
  • Adverse weather conditions.
