CLAIM COMPENSATION FOR LOST LUGGAGE
Law firm specialised in air passenger claims
No risk: we only get paid if you win.
Check Compensation*Filling in the form does not create any cost or commitment.
If your checked baggage did not arrive at destination and 21 days have passed, or the airline has confirmed it is lost, at Wings to Claim we claim for you compensation for lost luggage, the value of the bag, its contents and all expenses you can prove.
* There is a maximum compensation limit of 1,519 SDR per passenger, unless you made a special declaration of value at check-in.
We claim against all airlines operating in Europe and analyse each case with real legal criteria, not automated answers.
For lost baggage, the key rules are not Regulation 261/2004, but the Montreal Convention. You may be entitled to claim if the following conditions are met:
Your bag was checked, not just hand luggage.
You filled in the PIR at the airport.
21 days have passed without delivery, or the airline has confirmed in writing that it is lost.
You have documentation: PIR, baggage tag, booking, boarding pass, emails and receipts.
You want to claim the real value of the loss, not settle for a standard airline reply.
Important: for airlines, the PIR is essential to process the claim. It is best to do it before leaving the airport.
If you did not request the PIR at the airport before leaving, claim online immediately (some airlines allow this on their websites within the first 24 hours), but without this document the chance of success drops sharply.
If 21 days have not yet passed, we normally speak first of delayed baggage; if the bag still does not appear afterwards, it becomes lost luggage.
Check if I can claim for my lost baggageThere is no automatic fixed amount. We claim the real loss suffered, with a maximum limit calculated in Special Drawing Rights (up to 1,519 SDR per passenger), unless there is a special declaration of value. Note that the SDR value varies.
* Note that the SDR value varies. This is an indicative amount in euros at the current rate.
What does this amount cover?
The value of the lost contents
Essential expenses while the bag was missing
Other reasonable and proven damages (non-pecuniary loss)
* The more proof you have of the contents and expenses, the stronger the claim. Keep invoices, photos, tickets, emails and any document that helps reconstruct what was in the bag and the harm caused by its loss.
No tickets or invoices? Don't worry. Make a list from memory. We give it legal form so the airline cannot dismiss your valuation.
There is only one way to go above that legal limit.
Having completed a Special Declaration of Value
If at check-in you declared that your bag and its contents were worth more (for example €5,000) and paid a surcharge, the airline must cover up to that declared amount.
Go to the desk before leaving the airport. Report the incident immediately and ask them to issue the PIR.
Keep the PIR and reference code. That document is a key piece of your claim. Without those documents, the airline usually puts up more obstacles.
If your bag is late and you need clothes, toiletries, medication or other essentials, keep all invoices. Only then can reimbursement be claimed with force.
If 21 days pass without delivery, or the airline confirms the loss, file the formal claim and do not let time run out. If you contact us we will file all necessary documents on time so you do not lose your rights.
We review the documentation and claim for you against the airline.
To claim compensation if the airline has lost your bag quickly and effectively, it is best to keep these documents:
If you are missing a document, do not worry: we will still review your case and tell you how to obtain or prove the information needed

We handle claims against major national and international airlines for delays, cancellations, overbooking, missed connections and luggage problems.
At Wings to Claim we don't treat your case as just another automatic claim.
We are a law firm specialised in air passenger claims, so we can study each incident properly, claim more items
when applicable, and truly support you throughout the process.
Not every air claim is limited to the €250, €400 or €600 under Regulation (EC) 261/2004. We check whether your case allows claiming more.
Depending on the incident, there may be additional claimable amounts. That is why we analyse every file individually.
We don't process claims in bulk. We identify every claimable item and claim the maximum legally due.
Compensation for luggage problems.
If your suitcase is lost, delayed or damaged, you can claim financial compensation based on the type of incident and the damage suffered.
Claim up to 1,519 SDR (around €1,800)
Claim the basic necessary expenses you had to cover while waiting for delivery, such as clothes, hygiene products or other essentials.
Claim repair costs or financial compensation.
Important: complete the PIR at the airport before leaving.
Compensation for delayed, cancelled, overbooked flights or missed connections.
For delays, cancellations, denied boarding or missed connections, compensation can be up to €600 per passenger, depending on flight distance and the circumstances.
Fill in a simple form with details of your delayed, cancelled, overbooked or missed-connection flight, or luggage problem. It is quick, 100% online and submitting it involves no cost or commitment.
A lawyer specialised in air claims reviews your documents, assesses the real viability of the case and clearly explains what you can claim and what compensation you may be entitled to.
We submit and defend your claim against the airline. If needed, we also take legal action in court.
You get real follow-up by email, phone or WhatsApp. You always know where your claim stands and what the next step is.
If we win, you receive the compensation and we collect our agreed fees. If we don't win, you pay nothing.
At Wings to Claim you pay nothing upfront. We only charge if we secure your compensation.
Our fees depend on whether the claim is resolved out of court or needs to go to trial.
If we reach an agreement with the airline without going to court, we charge 25% + VAT of the compensation obtained.
If the airline does not pay and court action is needed, we charge 40% + VAT of the compensation obtained.

You can claim, among other cases, a delayed flight if you arrive at your final destination 3 or more hours late; a cancelled flight; overbooking or denied boarding against your will; a missed connection when an incident on a leg of the same booking makes you late to the final destination; a flight brought forward by more than one hour, which may be treated as a cancellation; lost, delayed or damaged checked luggage; and a downgrade to a lower class.
In general, you may be entitled to delay compensation if you arrive at your final destination 3 or more hours late, provided there are no extraordinary circumstances. The arrival time that counts is when at least one aircraft door opens. For cancellations, compensation may also apply if the airline notifies you less than 14 days in advance, unless it offers alternative transport within the legal margins. Compensation may also apply if you are denied boarding against your will.
For delays, cancellations, overbooking or missed connections, standard compensation can be €250, €400 or €600 per passenger depending on flight distance. If the airline offers alternative transport and you arrive within certain margins, that compensation may be reduced by 50%. Reasonable documented expenses may also be claimable when legally applicable. For checked luggage, the amount depends on proven loss and the Montreal Convention generally sets a limit of 1,519 SDR per passenger. If you are downgraded, you can also claim a partial ticket refund.
If the airline proves an extraordinary circumstance, standard financial compensation may not apply, but you still have the right to assistance and, depending on the case, a refund or alternative transport. It is not enough for the airline to claim it: it must prove it and show it could not avoid the consequences even by taking all reasonable measures. Extraordinary circumstances can include weather that prevents safe flying, airspace closure, war or serious political unrest, an air-traffic controller strike or a security risk. Normal technical problems or the airline's own internal issues usually do not exempt it from paying compensation.
No. If you are entitled to a refund, the airline cannot force you to accept a voucher instead of money. A voucher is only valid if you expressly accept it. If your flight is cancelled, you can choose between a refund or alternative transport. And if there is a long delay and you decide not to travel, you can also request a refund, which must be made within 7 days. Before accepting a voucher, review its conditions carefully so you do not unknowingly limit better options.
To claim a delayed, cancelled or overbooked flight, a missed connection or a luggage incident, you normally need documents proving who travelled, which flight was booked, what happened and what expenses you incurred. Typically you provide each passenger's ID, the booking or ticket, boarding passes if you still have them, airline communications and expense receipts. For luggage problems, it is also very important to keep the PIR and all suitcase-related documents.
If your suitcase does not appear, arrives damaged or is delivered late, act quickly: before leaving the airport, go to the airline desk and complete the PIR (Property Irregularity Report). Then keep the PIR copy, luggage tag, boarding pass, booking, photos and receipts for related expenses. For damaged luggage, written complaint must be made within 7 days of receipt. For delayed luggage, the deadline is 21 days from delivery. If it has not appeared after 21 days, it can be claimed as lost. Compensation depends on proven damage and is generally subject to the 1,519 SDR per passenger limit.
At Wings to Claim you pay nothing upfront. We only charge if we obtain compensation for the passenger. If the claim is resolved out of court, we charge 25% + VAT of the compensation obtained; if court action is needed, we charge 40% + VAT. Simply put: if you don't win, you don't pay.
Yes. In Spain, delays, cancellations, overbooking and missed connections can generally be claimed within 5 years of the incident. For luggage problems you must act sooner: damaged luggage requires written protest within 7 days; delayed luggage within 21 days of delivery; and court action for luggage generally expires after 2 years. That is why you should claim as soon as possible and keep all documents.
If you already claimed to the airline and they did not reply within a month or the answer was unsatisfactory, you can file a free complaint with AESA. For cases covered by the EU Regulation, you must first claim to the airline within 5 years of the incident and then, if needed, go to AESA within the following year. AESA also states that its decision is binding on the airline.
