La huelga prevista por Ryanair, por el conflicto con sus empleados, amenaza con paros los próximos meses de junio y julio. Siendo así, la aerolínea estaría obligada a abonar las indemnizaciones que recoge el Reglamento 261/2004 de entre 250 y 600 euros para los pasajeros afectados.
La aerolínea parece no llegar a una solución con sus empleados y los sindicatos europeos de los tripulantes de cabina amenazan con paros en los meses de verano con más tráfico aéreo y se verían afectados los derechos de los pasajeros.
En estos casos, la obligación a indemnizar es un hecho que avala el derecho comunitario y la jurisprudencia del Tribunal de Justicia de la Unión Europea (TJUE). El TJUE declara que las huelgas de personal no son circunstancias extraordinarias, dado que la gestión de personal forma parte de la actividad ordinaria de una empresa y no son ni imprevisibles ni inevitables.
¿Qué puedo reclamar por una huelga?
La aerolínea irlandesa low cost estaría obligada a abonar las indemnizaciones para los pasajeros que se vean afectados por la huelga. Además, no sólo tendrían derecho a esa compensación, sino que desde Wings to Claim también se reclaman los gastos ocasionados de la incidencia aérea, tales como noches de hotel, transporte, entradas de ocio, etc.
En caso de cancelación, la aerolínea también estaría obligada a ofrecer el reembolso íntegro del billete u ofrecer un vuelo alternativo, lo antes posible, incluida comida y bebida del pasajero.
¿Siempre existe indemnización en una huelga?
A pesar de que en este caso es posible reclamar, no siempre es así. Es más, el pasajero no tendrá derecho a una indemnización cuando la huelga se considere causa de fuerza mayor.
Si se trata de una huelga del personal propio de la aerolínea, la aerolínea no podrá eximirse de responsabilidad alegando que se trata de una circunstancia extraordinaria y ajena a la misma. En caso de que la aerolínea haya avisado con más de 2 semanas de antelación la cancelación del vuelo por huelga convocada, el pasajero no tendría derecho a indemnización pero la aerolínea estaría obligada a ofrecer un vuelo alternativo o al reembolso del billete.
En el caso de una huelga ajena, como lo sería la huelga de controladores aéreos, la compañía aérea tampoco podría desentenderse de sus pasajeros y tendrá que ofrecer el reembolso del billete en un plazo de 7 días; o la conducción hasta el destino final lo más rápidamente posible o en una fecha posterior que convenga al pasajero. Además, en caso de que sea necesario pernoctar, tendrán que acarrear con el coste del alojamiento, así como con el transporte y alimentación en todo caso.

Should the machine is usually running Windows XP, for instance, a memory threshold is 3.25GB. Installing in excess of this would simply constitute some sort of waste. Make sure one’s mother board can handle an upgrade volume, as well. Good blog post.
Great blog post. A few things i would like to make contributions about is that pc memory has to be purchased if your computer can no longer cope with anything you do with it. One can deploy two RAM memory boards with 1GB each, as an example, but not one of 1GB and one of 2GB. One should check the car maker’s documentation for the PC to ensure what type of memory space is necessary.
