Las compañías aéreas junto con las empresas de handling, han producido miles de pérdidas y retrasos en equipajes durante este verano, desde Wings to Claim, han dado solución a muchos de estos problemas y nos explican qué hacer si nos ocurre alguna de estas incidencias.
La pérdida de maletas en el aeropuerto es una posibilidad con la que contamos cada vez que cogemos un vuelo. Es más, puede resultar más que un inconveniente cuando llegamos al aeropuerto de destino, esperando desconectar.
Esto es lo que debes hacer si la aerolínea ha perdido tus maletas
1. Realizar el Parte de Irregularidad de Equipajes (PIR)
Ante la incidencia, siempre deberás dirigirte al Mostrador del Punto de Información que encontrarás próximo a las cintas transportadoras (suelen estar identificados como “EQUIPAJE”, “LOST & FOUND”, etc.) para solicitar el Parte de Irregularidad de Equipajes (PIR).
Cada compañía tiene su propio documento PIR, con este se documenta la apertura de una incidencia con el equipaje y dentro del mismo figuran los datos de vuelo del cliente y un número de referencia, que será el que utilices para poder buscar tu maleta, así como el teléfono de contacto donde el cliente podrá solicitar información sobre la incidencia de su equipaje sea retraso, pérdida o rotura.
2. Reclamar el daño, retraso o pérdida de maletas
Normalmente la aerolínea tratará de no compensarte el daño generado. Para realizar la reclamación por los inconvenientes causados por la pérdida, retraso o daño de la maleta, debes presentar una reclamación a abogados especialistas en la que deberás adjuntar tu copia del PIR, de acuerdo a los siguientes plazos establecidos en el Convenio de Montreal:
Daños en el equipaje: tienes 7 días desde la recepción del equipaje.
Retraso del equipaje: hasta 21 días desde la fecha en que deberías haber recibido el equipaje.
- La indemnización podrías ser de hasta 4.000€.
- Indemnización por gastos ocasionados: A la compensación por día de equipaje perdido (aprox. 70€) se puede añadir los gastos derivados de no disponer de la maleta, como: compra de útiles de aseo, ropa, etc. Se deben acreditar con tickets y facturas.
- Indemnización por daños y perjuicios: Además, se puede y debe justificar un daño y perjuicio por las molestias ocasionadas: no disponer de ropa en una reunión importante, no disponer de la maleta durante las vacaciones, pérdida de medicinas, etc.
Pérdida del equipaje: No hay límite establecido en el Convenio, pero se recomienda realizar la reclamación lo antes posible, una vez transcurridos los 21 días durante los cuales la maleta ha estado “retrasada”, o después de que la compañía aérea haya confirmado que el equipaje está perdido.
El aeropuerto se encarga de localizar el equipaje en los primeros 5 días de la pérdida. Después de este período, si aún no han sido localizados, el Departamento de Objetos Perdidos de la compañía aérea se hará cargo de realizar una investigación durante los siguientes 21 días.
3. Conocer los tipos de plazos en incidencias de equipaje
- En menos de 21 días se considerará equipaje retrasado. El principio general es el de cubrir los gastos de primera necesidad generados como resultado del retraso en la entrega del equipaje. Algunas aerolíneas pagan una cantidad por día, hasta un máximo, y otras realizan los pagos una vez comprobadas las facturas de los gastos en los que ha incurrido el pasajero.
- Pasados los 21 días desde el vuelo, lo tomamos como pérdida total de equipaje. De acuerdo con la normativa comunitaria, la aerolínea debe dar una indemnización hasta un máximo de 4.000 euros. Para ello, es necesario enviar todos los documentos de la incidencia con la que ha viajado. En caso de retraso, la indemnización varía en función del tiempo de entrega.
- En el caso de que tu equipaje aparezca dañado: muchas aerolíneas hacen un pago ajustado al valor de la maleta o al objeto de su interior que ha resultado dañado. 4. Saber que siempre tienes derecho a la indemnización en pérdida de maletas

Recuerda no aceptar nada de la compañía aérea sin haberte informado con un despacho de abogados especialista antes, ya que cualquier comunicación con la aerolínea podría suponer una disminución de Derechos sobre el retraso o pérdida de tu equipaje.
